Fundamentos constitucionais para as reivindicações do movimento pela justiça ambiental, no Brasil

Abstract

This work looks for bases for the claims of the Environmental Justice Movement. It starts with the report of this movement`s historical origin, in the United States, where the concepts of Environmental Racism, Environmental Injustice and Environmental Justice were formulated. It shows that, because of the universality of the causes against which it revolts, the Environmental Justice Movement spread for the world. It also shows that, in Brazil, the claims for Environmental Justice were already underlying to some popular struggles, but that, in this country, only recently a discussion was set up on Environmental Justice, which remains not so spread as desired, especially in the field of Law. It talks about the historical thing and the structure of the Rede Brasileira de Justiça Ambiental, the main articulator of this movement in Brazil. It analyses, considering the 1988`s Federal Constitution, the concept of Environmental Justice adopted by this net, in order to check if the claims of the Environmental Justice Movement have constitutional support.
