| Resumen en portugués brasileño: | Investiga-se, dentre as inovações que surgem com a mudança no marco regulatório das licitações públicas no Brasil, a figura do agente de contratação. A Lei n.º 14.133/2021 consiste na nova lei geral de licitações e contratações, que atende ao comando do art. 22, XXVII da Constituição Federal de 1988, em substituição à Lei n.º 8.666/1993. Partiu-se de um estudo sobre o histórico do tema das licitações públicas no Brasil, delimitação conceitual da licitação, disciplina constitucional acerca do referido instituto, e os fundamentos e princípios que lhe dão sustentação. Passa-se a tratar da nova lei de licitações em seu nascedouro, no processo legislativo a que foi submetida, com enfoque nas contribuições da Comissão Temporária de Modernização da Lei de Licitações e Contratos - CTLICON do Senado Federal. Propõe-se relação das mudanças trazidas pela Lei n.º14.133/2021 a serem vistas com mais atenção, dentre estas o surgimento do agente de contratação, a respeito do qual são feitos comentários sobre o modo como é tratado na nova lei, regulamentação infralegal, compatibilidade com o princípio da segregação de funções e o dever de ser este agente o impulsionador do processo licitatório. |
| Abstract: | Among the innovations that arise with the change in the regulatory framework of public tenders in Brazil, the figure of the contracting agent is investigated. Law n.º 14.133/2021 is the new general law on bidding and contracting, which complies with the command of art. 22, XXVII of the Federal Constitution of 1988, replacing Law n.º 8.666/1993. It started with a study on the history of the subject of public bidding in Brazil, conceptual delimitation of the bidding, constitutional discipline on the referred institute, and the foundations and principles that support it. The new bidding law in its inception is discussed in the legislative process to which it was submitted, focusing on the contributions of the Temporary Commission for the Modernization of the Bidding and Contract Law - CTLICON of the Federal Senate. A list of changes brought about by Law No. 14.133/2021 is proposed to be seen more carefully, among them the emergence of the hiring agent, about which comments are made on the way it is treated in the new law, regulation infralegal, compatibility with the principle of segregation of functions and the duty of this agent to be the driving force behind the bidding process. |
