| Abstract in Brazilian Portuguese: | Objetiva-se analisar a possibilidade de se terceirizar a atividade-fim das empresas brasileiras. Partindo dessa premissa, os estudos preliminares foram realizados com a análise de excertos jurisprudenciais de casos de terceirização, a leitura de posicionamentos doutrinários do tema e, por fim, a investigação da legislação existente. Especialmente no tocante às leis que regem a terceirização, fez-se uma pesquisa de como o instituto seria regulado em outros países que apresentassem afinidade jurídica com o Brasil. No caso brasileiro, estudou-se a Súmula nº 331 do TST e sua aplicação em casos práticos. Por fim, o trabalho deteve-se na análise da evolução do Projeto de Lei nº 4.330/04, em trâmite na Câmara dos Deputados, e suas implicações caso seja aprovado. |
| Abstract: | This study aims to answer the question about the possibility to outsource the core business of Brazilian companies. Departing from this premise, preliminary studies were conducted with the jurisprudential excerpts from case studies of outsourcing, the reading of doctrinal positions of the subject and, finally, the research of the legislation. Especially with regard to laws related to the outsourcing, the research was done to understand how the institute was regulated in other countries, focusing on places with legal affinity with Brazil. In Brazil, the precedent 331 of the TST and its application in practical cases werer analyzed. In the end, the work steadied on the analysis of the evolution of the Bill 4.330/04, pending in the House of Representatives, and its implications if approved . |
