| Abstract in Brazilian Portuguese: | Analisa-se o crime de cárcere privado na modalidade parental, que ocorre quando a vítima é descendente do agente, a partir da obra audiovisual “Enrolados” (DISNEY, 2010) e de caso real. Os objetivos resumem-se a investigar as causas que levam uma mãe ou um pai a manter seu próprio filho/a em cárcere privado, bem como analisar quais as consequências físicas e psicológicas causadas à vítima, além da abordagem das diferentes possibilidades de cometimento do crime e da busca por semelhanças e diferenças entre a história narrada pelo filme e os casos reais selecionados. Para isso, utiliza-se da pesquisa qualitativa e bibliográfica, por meio da leitura de artigos científicos e da doutrina jurídica nacional, além da pesquisa jurisprudencial para seleção do caso real analisado. |
| Abstract: | The crime of false imprisonment is analyzed in the parental modality, which occurs when the victim is a descendant of the agent, based on the audiovisual work “Tangled” (DISNEY, 2010) and real case. The objectives are to investigate the causes that lead a mother or father to keep their own child in private prison, as well as analyzing the physical and psychological consequences caused to the victim, in addition to addressing the different possibilities of committing the crime. and the search for similarities and differences between the story told by the film and the real cases selected. To do this, qualitative and bibliographical research is used, through reading scientific articles and national legal doctrine, in addition to jurisprudential research to select the real case analyzed. |
