Abstract

This work consists of discussing the content and extent of the possibility of regimen progression in a basis of preventive incarceration, bringing in its wake the jurisprudential and doctrinal disagreements. At first, general concepts are clarified, such as preventive incarceration and regimen progression. Then, it is discuss in details the application of legal instruments related to those two, including the recent changes. Still, it is discussed about the Habeas Corpus 98.145, as it was tha case that brought a new understanding to the Supreme Court. After that, this paper wants to study the interaction of both objects. Finally, it is brought to light the question of the necessity of reforming the summary binding 716.
