Uma análise sobre o assédio sexual como manifestação da discriminação de gênero nas instituições federais de ensino

Abstract

The main object of this research is the detailed study of the issues raised by the phenomenon of sexual harassment, as a manifestation of gender discrimination in federal educational institutions. The aggression in question can be viewed in two different ways: sexual harassment by blackmail or by environmental intimidation. It originated from the dynamics of labor relations, but it was not limited to this scenario, because the constancy of these aggressions is also present in the daily institutional relations experienced in the academic field and, here, sexual behavior stands out, when practiced by the teacher in face of student woman. It is an offense that makes women its special victims, violating their ability to self-determine and enjoy full access to education. Therefore, the aim is to understand what puts the female figure in this condition. In this sense, the present study aims to analyze the elements characterized by sexual harassment, based on the conceptualization presented, as well as to examine the manifestation of this practice in the public sphere, delimiting itself to federal educational institutions, therefore, to analyze the effects of this violence and the treatment of these victims; to point out that the existing institutional apparatus proves to be meager in terms of coping with, preventing and guaranteeing the sexual dignity of female students. These objectives, therefore, have the power of directing this study to the actions that are understood to be efficient in this posture of confrontation, having as a beacon the law nº 14.540/2023, enacted for this purpose. At the end of the research, the study verified that the practice of sexual harassment is a manifestation of violence intrinsically linked to a sexist and androcentric culture, which instrumentalizes this aggression in the face of gender oppression. It was found that the patriarchal culture maintains and feeds this scenario of violence on a daily basis. In this sense, it is understood that the most qualified weapon for confronting and preventing this offense is the promotion of a behavioral and cultural change, leaving in sight the forms of manifestation of this violence, the characterizing elements, as well as the reason for the women are the main victims. Literature review is used as a research methodology, through the qualitative examination of specialized bibliography (analysis of scientific articles, theses, dissertations, monographs and specialized doctrine). The research is pure and qualitative in nature, with descriptive and exploratory purposes.
