Abstract in Brazilian Portuguese: Busca-se analisar a autorização concedida por precedentes judiciais da Terceira Turma do Superior Tribunal de Justiça (STJ) que validaram cláusulas de supressão de garantias reais e fidejussórias inseridas em planos de recuperação judicial de empresas que foram aprovados em Assembleia Geral de Credores. Verifica-se que essas decisões têm potencial de lesionar o mercado de crédito no país e causam grande instabilidade jurídica. Adota-se a pesquisa bibliográfica e jurisprudencial como metodologia para este estudo. De início, são mostradas as diversas modificações e contribuições dos diferentes períodos históricos para a construção dos institutos do Direito Falimentar contemporâneo. Na sequência, faz-se análise comparativa do papel de protagonismo e soberania que a Lei n° 11.101/2005 concedeu à Assembleia Geral de Credores, assim como são apresentadas as principais características do sistema recuperacional vigente, com destaque para a esquema de proteção das garantias que foi insculpida pelo legislador. Faz-se então, a contextualização do cenário jurisprudencial atual no STJ e a apresentação dos precedentes destoantes, além de se expor suas implicações. Por fim, conclui-se que a supressão de garantias não é harmônica com as regras e princípios do sistema de recuperação judicial.
Abstract: The purpose os this study is to analyze the authorization granted by judicial precedents of the Third Section of the Superior Court of Justice that validated clauses of suppression of guarantees inserted in judicial reorganization plans of companies approved by the General Meeting of Creditors. These decisions have the potential to damage the credit market in the country and cause great legal instability. Bibliographic and jurisprudential research is adopted as the methodology for this study. At first, it’s showed the various modifications and contributions of the different historical periods for the construction of the institutes of contemporary Bankruptcy Law. Following is a comparative analysis of the role of protagonism and sovereignty that Law No. 1110 /2005 granted to the General Meeting of Creditors, as well as the main features of the current reorganization system, highlighting the scheme of protection of guarantees which was inscribed by the legislature. It is then made the contextualization of the current jurisprudential scenario in the Superior Court and the presentation of the conflicting precedents, besides exposing its implications. Finally, it is concluded that the suppression of guarantees is not in harmony with the rules and principles of the judicial reorganization system.
