| Abstract in Brazilian Portuguese: | No atual contexto social e econômico brasileiro, em que os responsáveis pelo Poder Executivo intencionam realizar profundas mudanças no sistema previdenciário, o presente trabalho objetiva demonstrar que as carreiras militares das Forças Armadas recebem um tratamento diferenciado quanto à aposentação de seus servidores em virtude das peculiaridades que envolvem sua atividade-fim. Desta forma, busca-se realizar um paralelo entre o servidor público civil e o militar, além de comparar as regras gerais que regem a aposentadoria nos Regimes Próprios e Geral de Previdência Social. Realiza-se também um estudo sobre as principais mudanças propostas pelo Projeto de Lei de Reestruturação das Carreiras Militares, apresentado em Março de 2019 e que tramita nas Casas Legislativas, com enfoque sobre a aposentadoria. É possível observar que se trata de uma carreira de estado rica em deveres e relativamente pobre em direitos que, apesar de dever se adequar às mudanças que certamente ocorrerão, não pode ser tratada da mesma forma de outras categorias profissionais, principalmente em razão da necessidade de higidez física e psicológica para o exercício da função. |
| Abstract: | In the current Brazilian social and economic context, in which those in charge of the Executive Branch want to make profound changes in the social security system, this work aimed to show that the professional category composed by military of Brazilian Armed Forces need different treatment for retirement due the peculiarities involving its end-activity. In this way, we tried to create a parallel between the public civil servant and the military, in addition to comparing the general rules governing retirement in several Social Security Regimes. A study was also carried out on the main changes proposed by the Bill proposing a whole Restructure of Military Careers, presented in March 2019 and which is being discussed in the Legislative Houses, focusing on retirement.. It was possible to observe that military is a career of State, rich in duties and relatively poor in rights. Although it must adapt to the changes that will certainly occur, it can’t be treated in the same way of other professional categories, mainly due to the high physical and psychological fitness needed for their activity. |
