| Abstract in Brazilian Portuguese: | O presente trabalho tem por objetivo analisar as mudanças introduzidas pela Lei 12.403, sancionada em 4 de maio de 2011, concernentes à inclusão de um rol de novas medidas cautelares diversas da prisão provisória e a capacidade dessas medidas para garantir a eficácia do processo à luz do princípio da proporcionalidade. A prisão cautelar ganha a importante característica de subsidiariedade em face das outras, que só é possível com a aplicação do princípio da proporcionalidade, que impede que direitos fundamentais do indivíduo e da sociedade não sejam violados tanto pelo excesso como pela proteção deficiente do Estado. |
| Abstract: | The present work aims to analyze the changes introduced by Law 12,403, enacted on May 4, 2011, concerning the inclusion of new list of the different precautionary measures of provisional detention and the capacity of these measures to ensure the effectiveness of the process under the principle of proportionality. The arrest precautionary wins important feature of subsidiarity in the face of the others measures, which is only possible with the principle of proportionality, which prevents the fundamental rights of the individual and society are not violated by both the excess and the weak protection of the state. |
