| Abstract in Brazilian Portuguese: | O presente trabalho visa analisar a problemática do tipo penal aberto na Lei 8.666/93. Para lograr tal êxito serão analisados os elementos que compõe a base do estudo, como a análise do tipo penal aberto, do instituto da licitação, e de outros aspectos basilares. Prosseguindo com o pensamento será estudado o artigo 96 da referida Lei, podendo assim compreender a formação da problemática proposta. Em seguida será examinado o posicionamento de órgãos de controle e do Poder Judiciário, e as críticas fundamentais para o avanço do estudo. Posteriormente encerrando toda a análise e consequentemente o trabalho será apresentado meios que possam vim a solucionar a problemática apresentada pela presente pesquisa. |
| Abstract: | This paper aims to analyze the problems of the open criminal offense in Law 8,666 / 93. To achieve such success the elements that make up the basis of the study, as analysis of the open criminal type, the institute's bidding, and other basic aspects will be analyzed. Continuing with the thought Article 96 of the said Act will be studied, thus being able to understand the formation of problematic proposal. Then be examined positioning control agencies and the judiciary, and fundamental critical to the advancement of the study. Later waxed all the analysis and therefore the work will be presented means that they can come to solve the problems presented by this research. |
