| Abstract in Brazilian Portuguese: | O estudo trata do procedimento de abordagem policial, analisando-se todos os seus aspectos jurídicos, sejam constitucionais ou infraconstitucionais, com ênfase nos requisitos e limites impostos aos agentes policiais quando intervêm nos direitos fundamentais da pessoa humana. Procura-se, também, garantir o entendimento dos conceitos jurídicos da busca pessoal e fundada suspeita, do uso da força e do uso de algemas, necessários para o aprofundamento do tema apresentado. E por fim, esclarecer as consequências jurídicas da realização da abordagem policial sem o devido respeito à legalidade, proporcionalidade e necessidade. |
| Abstract: | The study deals with the police approach procedure, analyzing all its legal aspects, whether constitutional or infra, with emphasis on the requirements and limitations imposed on police officers when they intervene in fundamental rights of the individual. Wanted also ensure understanding of legal concepts of personal and founded suspicion pursuit, use of force and the use of handcuffs, need to deepen the theme presented. Finally, to clarify the legal consequences of carrying out the police approach without due respect for legality, proportionality and necessity. |
