| Resumen en portugués brasileño: | A crise de inefetividade da prestação da tutela jurisdicional, mormente no que se refere à tutela executiva, ensejou significativas modificações no diploma processual civil brasileiro, as quais redefiniram instrumentos executivos já superados pela ineficácia e que embaraçavam a obtenção de um resultado efetivo. O objetivo geral desta dissertação é investigar de que modo o instituto da penhora on line se relaciona com a superação desta crise e, por conseguinte, com a concretização do direito à tutela jurisdicional. Para tanto, procura-se analisar os fundamentos constitucionais deste instrumento processual no contexto dos princípios do acesso à justiça, da efetividade da tutela jurisdicional e da proporcionalidade. |
| Abstract: | Ineffectiveness of crisis by courts , especially with regard to executive tutelage , gave rise significant changes in the Brazilian civil procedural law, which redefined executives instruments already overcome the inefficiency and hindered to achieve an effective result. The overall objective of this thesis is to investigate how the online pledge institute relates to overcoming this crisis and therefore to the realization of the right to judicial protection . Therefore , we try to analyze the constitutional foundations of this procedural tool in the context of the principles of access to justice, the effectiveness of legal protection and proportionality. |
