| Abstract in Brazilian Portuguese: | Aborda a dimensão constitucional da união estável, após uma breve análise da gênese e evolução do instituto, considerando o avanço do tratamento jurisdicional e legislativo no estado brasileiro. Enfoca a evolução dos dispositivos legais acerca do tema para analisar a parca atenção dispensada pelo atual código civil que, no que toca aos direitos sucessórios dos companheiros, representou um retrocesso social em face da previsão constitucional. |
| Abstract: | After briefly analyzing the genesis and evolution of the institution of stable unions, this paper deals with the constitutional dimension of stable unions, as regards the progresses in jurisdictional and legislative treatment by the brazilian state. It also focuses on the evolution of applicable legal devices to analyze the scanty attention dispensed by the current civil code to the sucessory rights of consorts, which represents a social retrocess in light of constitutional provisions. |
