| Abstract in Brazilian Portuguese: | Trata-se de artigo sujeito a analisar o impacto da primeira sentença condenatória do Estado brasileiro perante a Corte Interamericana de Direitos Humanos no caso Damião Ximenes Lopes. Descreve-se o trâmite processual interamericano,bem como trata das controvérsias materiais e processuais em relação à execução de sentenças internacionais de direitos humanos à luz do Decreto 6.185/2007 e da Emenda constitucional n. 45/2004. Tem por objetivo discutir a forma como o dever do Estado em promover e garantir o cumprimento integral dos dispositivos da Convenção Americana de Direitos Humanos se estabelece na prática jurídica no Brasil. |
| Abstract: | It is Article subject to analyze the impact of the first sentence of the Brazilian State before the Inter-American Court of Human Rights in the case Damião Ximenes Lopes. It describes the inter-procedural action, and deals with the substantive and procedural disputes regarding the implementation of international judgments of human rights in the light of Decree 6,185 / 2007 and the Constitutional Amendment n. 45/2004. It aims to discuss how the duty of the State to promote and ensure full compliance with the American Convention on Human Rights devices is established in legal practice in Brazil. |
