| Abstract in Brazilian Portuguese: | O presente trabalho tem por objetivo precípuo analisar a legitimidade da investigação criminal direta realizada pelo Ministério Público, uma vez que inúmeros questionamentos foram, novamente, levantados após a discussão e votação da Proposta de Emenda Constitucional nº 37/2011. Pretende-se, no primeiro capítulo, discorrer sobre a origem histórica do Órgão Ministerial, bem como seu papel no contexto das Constituições do Brasil e do Estado Democrático de Direito. No segundo capítulo será abordada especificamente a função de investigação penal levada a efeito pelos membros do Parquet, considerando o posicionamento da doutrina e das Cortes Superiores. No derradeiro capítulo, serão feitas considerações sobre a PEC 37/11, com o estudo de seu objeto e tramitação no Congresso Nacional. |
| Abstract: | The present work has the main objective to analyze the legitimacy of direct criminal investigation conducted by the prosecutor, since many questions were again raised after discussion and voting on the Proposed Constitutional Amendment No. 37/2011. It is intended, in the first chapter, discuss the historical origin of the Ministerial Board, as well as its role in the Constitutions of Brazil and the Democratic State. In the second chapter will be specifically addressed the role of criminal investigation carried out by members of the Parquet, considering the positioning of the doctrine and the High Courts. In the final chapter, considerations will be made on the PEC 37/11, with the object of his study and the National Congress. Moreover, in the course of the paper, expose yourself the arguments that lead to conclusions about the constitutionality of the proposal mentioned. |
