| Resumo: | Os Núcleos de Prática Jurídica, além do seu papel pedagógico, cumprem função basilar na viabilização do direito fundamental ao acesso à justiça consagrado na Constituição Federal Brasileira de 1988, especificamente aos tidos por hipossuficientes. Para além do viés pedagógico, responsável por complementar a vivência do discente nos cursos de Direito pelo Brasil, os Núcleo de Práticas Jurídicas são importantes ferramentas de alcance a um público que encontra diversas barreiras no percurso até a efetiva solução jurídica que busca, sejam elas barreiras sociais, econômicas ou até de acessibilidade à informação. Impõe-se, portanto, uma necessidade de capilarizar a atuação dos Núcleos de Prática Jurídica entre outros órgãos que encontram - em maior escala – penetração nessas camadas da população. De outra forma, aos Núcleo de Práticas Jurídicas é cediço a necessidade de observarem com maior lucidez os indicadores que atestam o alcance do seu objetivo, oportunizando as mudanças devidas. Na figura de promotor do acesso à justiça, quaisquer análises superficiais das sobre os dados de desempenho do Núcleo de Práticas Jurídicas ou até mesmo, a sua ineficiência gestão, podem pôr sob ameaça tanto as duas verticais cumpridas pelo por este órgão, o viés pedagógico e a assistência jurídica. Ante a isso, é possível aproximar a natureza da atuação do Núcleo de Práticas Jurídicas à prestação de serviço, relacionar indicadores aos objetivos traçados, medir percepção dos atores deste processo, rever abordagens de gestão e os ganhos que levem a entidade ao seu objetivo, considerando os limites definidos pelo Ministério da Educação. Na pesquisa, analisou-se o Núcleo de Prática Jurídica do curso de Direito da Universidade Federal do Ceará nos anos de 2018 e 2019 na disciplina de Estágio Supervisionado II, recorte que possibilitou o entendimento dos principais obstáculos enfrentados pelo órgão nesse desafio, bem como a premente necessidade de comunhão de aspectos jurídicos e de gestão estratégica para que seja possível potencializar o acesso à justiça por esta via. Logo, não se trata de análise da relevância pedagógica do Núcleo de Práticas Jurídicas para a formação do discente, mas sim no meio utilizado para esse alcance, valendo-se de conceitos atinentes ao campo da Administração e os relacionando à eficiência e à eficácia das suas atividades. centrando-as nas interações com os assistidos. |
| Abstract: | In addition to their pedagogical function, the Legal Practice Center fulfills a basic function in making the fundamental right to access to justice enshrined in the Brazilian Federal Constitution of 1988, specifically those considered by the under-privileged. Responsible for complementing the experience of students of Law courses in Brazil, Legal Practice Centers are important tools to reach populations that encounter different barriers on the way to the effective legal solution they seek, whether social, economic or even access to information. Therefore, it is necessary to capillarize the work of the Legal Practice Centers among other agencies that find - on a larger scale - penetration in these classes of the population. Moreover, it is necessary for the Legal Practice Centers to carefully observe the indicators that verify the achievement of its objective, allowing the changes it needs. In the figure of promoter of access to justice, any superficial analysis of the performance data of the Legal Practice Centers or even their inefficiency in management, can put under threat both the two verticals performed by this body, the pedagogical and legal assistance. In view of this, it is possible to approximate the nature of the activities of the Legal Practice Centers to the service provision, therefore, relating the indicators to the objectives set, measuring the perception of the actors in this process, reviewing the management approaches and the gains that lead the entity its objective, considering the limits defined by the Ministry of Education. In this research, in the Supervised Internship II discipline, the Legal Practice Centers of the Law School of the Federal University of Ceará was analyzed in the years 2018 and 2019. These parameters allowed the understanding of the main obstacles faced by the Center in this challenge, as well as the pressing need for communion and legal aspects of strategic management so that you can enhance access to justice in this way. Therefore, it is not an analysis of the pedagogical relevance of the Legal Practice Centers for the training of students, but rather the means used for this purpose, using concepts related to the Administration and relating them to the efficiency and effectiveness of its activities, focusing them on interactions with those assisted. |
