| Resumo: | O exercício da atividade de polícia judiciária militar na PMCE e o ordenamento constitucional: uma visão crítica. Identificam-se as atividades de polícia judiciária militar no âmbito estadual bem como da Justiça Militar Estadual. Indicam-se as diversas formas de como realizar um inquérito policial militar e do auto de prisão em flagrante delito, assim como as disposições do Código de Processo Penal Militar que se encontram em confronto com a Constituição Federal de 1988. Estabelece-se uma relação entre a teoria processual penal militar e a prática do dia-a-dia executada pelos oficiais da PMCE. Conclui-se que, pelo excesso de tarefas atribuídas ao oficial, assim como pela falta de disciplinas como prática forense penal militar e pelo excesso de erros nos diversos procedimentos, é viável que se crie uma Delegacia de Polícia Judiciária Militar na estrutura da Polícia Militar do Ceará. |
| Abstract: | The exercise of the activity of judiciary policy to militate in the PMCE and the constitutional order: a critica I vision. The activities of judiciary policy are identified to militate in the state scope as well as of State Military Justice. The diverse forms of as to carry through a police inquest to rnilitate and of auto of caught in the act the delict are indicated, as well as the forecasts of the Code of criminal procedure To militate that they meet in confrontation with the Federal Constitution of 1988. The relation between the procedural theory criminal military man and the practical one is established of day-by-day executed by the officers of the PMCE. One concludes that, for the excess of tasks attributed to the officer, as well as for the lack of you discipline as practical forensic criminal military man and for the excess of errors in the diverse procedures, is viable that if it creates a Police station of Judiciary Policy To militate in the structure of the Military Policy of the Ceará. |
