| Resumo: | O controle externo da atividade policial pelo Ministério Público Estadual, na Polícia Militar do Ceará. Fazem-se considerações gerais sobre o controle externo da atividade policial, decompondo-as em origem, conceito e finalidade deste controle. Ainda, no âmago destas considerações gerais, trata-se da alusão ao sistema jurídico de freios e contrapesos entre os órgãos públicos, da abrangência do Ministério Público Brasileiro e dos órgãos sobre os quais incidem o supramencionado controle externo. Apresenta-se a fundamentação constitucional do controle externo da atividade policial, analisada sob os prismas das Constituições Federal e Estadual, das Leis Orgânicas Nacionais do Ministério Público dos Estados e da União, dos Códigos de Processos Penal e Penal Militar, da Lei Complementar Estadual nº 9/98, do Ato Normativo Estadual nº 1/99 e do Ministério Público Militar Estadual. Estabelece-se posicionamento sobre a operacionalização do controle externo da atividade policial, iniciando com o controle sobre a atividade de polícia, que subdivide-se no papel da Corregedoria-Geral dos Órgãos de Segurança Pública e Defesa Social e no papel do Ministério Público neste Órgão Corregedor. Comenta-se, ainda, sobre os limites legais e éticos do controle externo pelo Parquet, o caráter criminal do referido controle, as relações entre o Ministério Público Militar e a Polícia Militar Estaduais, a aplicação da Lei Complementar Estadual nº 9/98, as centrais de inquérito e os procedimentos do Promotor de Justiça e os benefícios que esse controle trará após desmistificado. Apontam-se, finalmente, a importância da pesquisa de campo como termômetro do entendimento da tropa em face ao tema proposto, a aplicação e análise da pesquisa de campo junto ao seu público alvo e as propostas para se melhorar o exercício do controle externo da atividade policial pelo Ministério Público Militar Estadual. |
| Abstract: | Military Policy of the Ceará. General considerações become on the external control of the police activity, decomposing them in origin, concept and purpose of this control. The external control of the police activity for the State Public prosecution service, in the Still, in âmago of these general considerações, one is about the alusão to the legal system of checks and balances between the public agencies, of the abrangência of the Brazilian Public prosecution service and the agencies on which they happen the supramentioned external control. It is presented constitutional recital of the external control of the police activity, analyzed under the prisms of the Constitutions Federal and State, the National Organic Laws of the Public prosecution service of the States and the Union, the Codes of criminal procedure and Criminal Military man, of the State Complementary Law nº 9/98, of the State Normative Act nº 1/99 and of the Public prosecution service to militate State. Positioning is established on the operacionalização of the external control of the police activity, initiating with the control on the activity of policy, that is subdivided in the paper of Corregedoria-Geral of the Agencies of Social Public and Prohibited Security and in the paper of the Public prosecution service in this Corregedor Agency. It is commented, still, on the legal and ethical limits of the external control for the Parquet, the criminal character of the related control, the relations between State the Public prosecution service To militate and the Military Policy, the application of the State Complementary Law nº 9/98, the central offices of inquiry and the procedures of the attorney general and the benefits that this control will bring after demystified. They are pointed, finally, the importance of the field research as thermometer of the agreement of the troop in face to the considered subject, the application and analysis of the research of together field to its white public and the proposals to improve the exercise of the external control of the police activity for the Public prosecution service to militate State. |
