| Resumo: | Este trabalho investiga a legitimidade de intervenções artísticas no patrimônio cultural resguardado pelo instituto jurídico do tombamento a partir do estudo de caso do grafite realizado no Farol do Mucuripe e de sua posterior ocupação pela comunidade do Serviluz. Apresenta-se o histórico do direito ao patrimônio cultural no Brasil. Analisam-se as legislações constitucionais e infraconstitucionais referentes à tutela do patrimônio cultural. Estuda-se o instituto do tombamento a partir do Decreto-Lei nº 25 de 30 de novembro de 1937. Delineia-se o histórico das teorias da conservação e do restauro. Introduzem-se as tendências contemporâneas da preservação, que justificam as intervenções artísticas no patrimônio cultural tombado. Narra-se o histórico de usos e abandonos do Farol do Mucuripe. Apresentam-se, mediante as entrevistas realizadas, as perspectivas dos grafiteiros e dos moradores do Bairro Serviluz sobre o grafite no Farol. Relata-se a ocupação do Farol do Mucuripe pelo coletivo Servilost. Afirma-se que as intervenções artísticas realizadas no Farol do Mucuripe contribuem para a sua preservação e fazem parte dos valores que constroem a significância do bem cultural. Evidencia-se o quanto o preservacionismo tradicional não abarca a realidade das cidades contemporâneas. Demonstra-se a necessidade da aplicação dos conceitos de significância cultural, de sustentabilidade cultural e de democratização da preservação na gestão patrimonial e na análise das intervenções artísticas em patrimônios culturais. Conclui-se que são legítimos o grafite e a ocupação do Farol do Mucuripe devido ao seu estado de abandono por parte do Poder Público e porque as intervenções somaram valores culturais ao patrimônio. Manifesta-se apoio à gestão comunitária do bem cultural. |
| Abstract: | The present work aims to investigate the legitimacy of artistic interventions on the cultural heritage juridically protected and listed as places of historic and cultural interest. This work analyzes the case of the graffiti that was done on the Farol do Mucuripe and its subsequent occupation by the Serviluz community. The historical right to cultural heritage is presented in Brazil. The constitutional and infraconstitutional laws that refers to the protection of cultural heritage are analyzed. Starting from the Decree-Law No. of November 30, 1937 this work studies the legal institute of listing of places of historic and cultural interest. The historic of conservation and restorations theories are delineated. The contemporary trends of preservation that justifies the artistic interventions on cultural listed buildings, are introduced. The historic of uses and abandonment of the Farol do Mucuripe are narrated. The perspectives of graffiti artists and the residents of the Serviluz neighborhood about the graffiti done on the Farol do Mucuripe are presented through interviews that were done. The occupation of the Farol by the collective Servilost is reported. It is stated that the artistic interventions made in the Farol do Mucuripe contribute to its preservation as well as they are part of the values that build the significance of cultural good. It is evidenced how much the traditional preservationism does not cover the reality of contemporary cities. It is demonstrated the need of application of concepts such as cultural significance, cultural sustainability and democratization of the preservation on the patrimonial administration and in the analyzes of artistic interventions on cultural heritage. It is concluted that the graffiti and the occupation of the Farol do Mucuripe are legitimate due to its state of abandonment by the government and also because the interventions have added cultural values to the heritage. It is expressed support to the community management of the cultural good. |
