Crime e políticas públicas: justiça retributiva ou justiça distributiva?

Abstract

The enlargement of the violent urbane criminality in the Brazil has brought the debate about Public Security politics. This article tries to confront the two principal explications to the phenomenon. In a side, who sees the fundamental cause to the criminal increase in the social uniqualities, proposing that the reduction of crimes just will be possible with the reduction of social differences (in the prospect of Distribution Justice); Otherwise, who emphasises the weakness of the State like the fundamental element for the criminality numbers ascention in the last twenty years (in the prospect of the Retribution Justice). Finishing, there are some facts that the two positions and some fundamental questions to the criminal control in the public politics agenda (private security, narcotic traffic, police's reforms, etc.).
