Abstract

In this article we analyzed the possible relations between Democracy and Constitution, and between Democracy and Human Rights, so in the context of National State, as in the context of International Community. Studies of Constitutional Law, International Law and Communitary Law were necessary. The historical e ontological aspects of Democracy, Constitution and Human Rights were considered in order to achieve the conclusion that there is no Constitution without Democracy, neither Human Rights without Democracy.
