| Abstract in Brazilian Portuguese: | De acordo com Ronald Dworkin e Robert Alexy, princípios e regras são espécies diferentes de normas jurídicas. Com efeito, se, de um lado, as regras são aplicadas no modo do tudo-ou-nada, de outro, os princípios possuem uma dimensão de peso ou importância que as regras não têm. Nesse contexto, o presente artigo tem como propósito analisar as teorias de Dworkin e de Alexy quanto ao assunto, enfatizando as diferenças que são feitas entre regras e princípios, e abordando, outrossim, as críticas mais freqüentemente feitas no tocante a tal distinção. |
| Abstract: | According to Ronald Dworkin and Robert Alexy, legal principles and legal rules are both kinds of juridical norms that differ in the character of the direction they give. Really, according to them, if, on one hand, rules are applicable in an all-or-nothing fashion, on the other hand, principles have a dimension of weight that rules do not have. In this context, this article has the purpose of analyzing their theories about the subject, emphasizing these differences that they make between rules and principles. It will also analyze the most common opinions against such approach. |
