Abstract

This article will present the issue of solidarity as a limiting instrument of generations, in the name of the necessary sustainability to render the human right to the environment effective, from the demand of environmental damage precaution. Thus, it aims at presenting the hypothesis of solidarity, as a fundament of the human right to the environment, being an effective toolto justify, in the name of yet non-existing subjects, limits imposed upon potentially degrading conducts carried out by existing subjects in light of precaution as an internationally instituted rule. It will also present the need of a conceptual opening in what refers to the idea of solidarity, capable of surpassing the model based on reciprocity and instituting a new ethical position, an ethics for the future.
