Abstract

The Inter-American Court of Human Rights presents itself as an independent and autonomous judicial institution, which preeminent objective is the application and interpretation of the Inter-American Commission on Human Rights. The trial of cases contrary to the states for violation of human rights becomes possible through the operation of the referred Court. A sentence can be rendered (by the Inter-American Court), which will have to be abided by the states, otherwise, in case the state does not abide it, a penalty of political nature can be applied before the Organization of American States. The observance of human rights and the prevalence of human dignity are highlighted in the American context and recognition of the jurisdiction of the Inter by states, individuals guarantees an effective and important sphere supplementary guarantee of human rights where national institutions are deemed missing or flawed. It is evident that the study of the Inter-American Court is of great interest to the extent that their decisions produce significant effects on the States that recognize its jurisdiction. Therefore, this article highlights the important role played by the Inter-American Court of Human Rights for effective protection of individual rights in the Americas for the final draw some considerations about the novel control of conventionality.
