Particularidades das reformas previdenciárias no estado de Sergipe e no município de Aracajú em face da EC nº 103/19

Abstract

The 2019 social security reform led to significant changes in the Special Social Security Systems - RPPS and in the general social security system - RGPS, establishing new rules for accessing the benefit and dynamics for calculating earnings. Given the freedom of the federation entities to edit their social security reforms, the motivation of the social security reform to reduce inequalities between the RPPS and promote income distribution is put at risk. The objective of this study is to investigate the impacts of the 2019 social security reform on the Sergipe and Aracaju/SE Regime. Through a bibliographical and normative research, it is intended to reflect on the evolution of social security regulations and the real effects on subnational entities. Faced with concurrent competence, each entity of the federation must reform its social security legislation in order to contain public spending. The objective is to portray the legislative changes in the State of Sergipe and Aracaju, seeking to visualize the depth of the effects of the reform idealized by the Union. The difficulties of the erosion of the 2019 social security reform are addressed, such as the maintenance of more beneficial rules in the RPPS Aracajuano and Sergipe. The construction of an abyss of rights between federal public servants and public servants in Aracaju is evident. In this scenario, it can be seen that the social security regimes themselves are being public instruments of social inequalities, whether between the social security regimes themselves, as well as the general social security regime. The weakening of the social security reformist movement in the state and municipal RPPS indicates that the contours of the rules for accessing benefits will create a scenario of disparities between the entities of the federation, especially for high-ranking employees of the municipal and state public administration. Certainly, challenges are similar to those of the RPPS, whether due to the influences generated by the proposals to unify the RPPS with the RGPS, or due to the interest of private pensions in the management of public resources in the area of social security.
