| Resumen en portugués brasileño: | A norma jurídica não se limita mais a descrever apenas o comportamento desejado de um ponto de vista social, nem se restringe tampouco a proteger o comportamento economicamente útil. As novas estruturas normativas se funcionalizaram socialmente, passando a promover valores centrados na dignidade da pessoa humana, orientando-se pela redução das desigualdades bem assim pela construção de uma sociedade mais justa, fraterna e solidária. O Direito Civil, dentre as muitas forma de expressão da ordem jurídica, a despeito da persistência na continuação da tradição herdada do direito romano-canônico, não se furtou, como expressão primeira da cidadania, porque nele – o Direito Civil - se contém a vida do cidadão, de se abrir, na contemporaneidade, aos influxos de fatores éticos e socializantes das relações jurídicas, em que o indivíduo assume a centralidade das preocupações normativas. É nessa ordem de idéias que se coloca o tema deste ensaio: o exercício, de forma abusiva do direito assegurado pela ordem jurídica ao sujeito de direito. A questão será tratada do ponto de vista histórico, com o intuito de encontrar o fundamento de que a modernidade haverá de se valer para construir a teoria do abuso de direito; em seguida, o fenômeno será examinado nas legislações que apresentam forte influência no Direito Civil brasileiro com o conseqüente e posterior exame do direito estrangeiro para poder identificar as possíveis contribuições do direito estrangeiro. |
| Abstract: | The legal standard is no longer limited to just describe the desired behavior from a social point of view, not restricted either to protect the economically useful behavior. The new normative structures funcionalizaram socially and began to promote values centered on human dignity, guided by the reduction of inequalities as well as the construction of a more just, fraternal and solidary society. The Civil Law, among the many forms of expression of the law, despite the persistence in continuing the tradition inherited from the Roman-canon law, not failed, as the first expression of citizenship, because it - the Civil Right - it contains life citizen, to open, in contemporary times, the inflows ethical and socializing of legal relations, in which the individual assumes the centrality of normative concerns factors. It is in this vein that stands the test of this theme: the pursuit abusively right guaranteed by law subject to the law. The issue will be addressed from the point of view of history, in order to find the ground that modernity will make use of to build the theory of abuse of rights; then the phenomenon will be examined in the laws that have strong influence in the Brazilian Civil Law with the consequent and subsequent examination of foreign law in order to identify possible contributions of foreign law. |
