Conversando com Marx sobre o estado e o direito: análise dos escritos da Gazeta Renana para política, comércio e ofícios (1842-1843)

Abstract

The present work aims at presenting an analysis of the concepts of State and Law throughout the course of Karl Marx‘s experiences as a journalist for the Rhenish Newspaper for Politics, Commerce and Trade (Rheinische Zeitung für Politik, Handel und Gewerbe) ranging from 1842 until 1843. It is intended to cover the historical and biographical context dated from the beginning of his political activities as a journalist, stressing out his critical positions regarding the Prussian State, which featured increasingly authoritarian and absolutist measures. The critics towards the Prussian State are well set in the articles in which Marx analyses the Instructions to censorship and in the writings on the debates of the VI Rhenish Diet on freedom of press, printed respectively in the Anedokta and in the Rhenish Newspaper. It was then aimed at sketching an analysis that could contribute to the understanding of the marxian thought, above all, in its relationship with Law. Therefore two of the main texts in which Marx deals with this subject are studied. It is believed that, from these writings, it is possible to frame the author‘s position regarding the legal thought, as well as the complex legal generative process as a whole. The studied texts are: The philosophical manifest of the historical school of Law and Debates on the wood theft law. The method consisted in an immanent reading of the writings of the young journalist, with respect to the internal coherence of the concepts laid by him, instead of leaving this task to a ‗third party‘, and the exclusive resource of the commented bibliography.
