Resumo: Nas últimas décadas, os avanços tecnológicos diminuíram, das mais diversas formas, as distâncias, tornando a migração em massa uma realidade em várias partes do mundo. Em contrapartida, cresceu também a preocupação com as fronteiras externas dos Estados e os discursos de criminalização da figura do migrante, o que culminou com a securitização dos movimentos migratórios. Diante dessa realidade, a tese defendida é a de que a relação estabelecida entre a gestão estatal desses fluxos e os direitos titularizados pelos migrantes que se utilizam de rotas marítimas tem se baseado em um modelo de governança conflitiva, tendo em vista a preponderância das forças de segurança como principal interlocutor das políticas imigratórias, em prejuízo dos direitos titularizados pelos migrantes em trânsito. O objetivo geral desta pesquisa será a verificação da existência de limites impostos ao exercício da soberania estatal sobre a mobilidade humana, ou seja, em que situações a observância aos direitos humanos deve superar a soberania dos Estados no que concerne aos migrantes pelo mar, a fim de se verificar a possibilidade de superação do modelo de governança conflitiva. O fenômeno das migrações pelo mar e os riscos inerentes a estas não são um problema restrito a um único continente. Essas questões, no entanto, até o momento não receberam o tratamento internacional apropriado. Milhares de vidas de migrantes já foram perdidas em travessias pelo mar em todo mundo, em decorrência das estratégias de controle de fronteiras praticadas por muitos Estados. Logo, verifica-se a urgência da pesquisa proposta, a fim de possibilitar a reformulação das políticas migratórias em nível internacional. No tocante ao método de investigação adotado, a pesquisa é desenvolvida a partir do método indutivo, sendo realizada uma análise bibliográfica, documental e jurisprudencial. O desenvolvimento deste trabalho divide-se em quatro capítulos. Na primeira parte, analisa-se a relação estabelecida entre soberania e imigração e de que forma esta é legitimada pela segurança internacional. No segundo capítulo, busca-se verificar se as medidas de securitização de vulneráveis no mar adotadas por Estados costeiros desenvolvidos devem ser consideradas como expressão do exercício regular da soberania estatal ou uma ofensa ao direito humano de locomoção. No capítulo seguinte, investiga-se se os migrantes pelo mar titularizam um direito humano de migrar ou se estes são apenas titulares de direitos imigratórios. O último capítulo deste trabalho analisa se a problemática desta tese seria um problema de governança ou de ausência de direitos, propondo, ao final, possíveis soluções com base em normas de soft law. Concluiu-se que o direito dos refugiados deve ser considerado como limite mínimo a ser respeitado pelos Estados signatários da Convenção de 1951, assim como por todo e qualquer Estado no tocante ao princípio do non-refoulement, no estabelecimento de políticas migratórias. Assim, é essencial o reconhecimento expresso quanto à necessidade de observância desses direitos nos documentos de soft norm que se propõem a estabelecer uma governança migratória, tendo em vista que o direito ao refúgio é uma relevante mitigação ao exercício da soberania estatal sobre as questões migratórias.
Abstract: In the last decades, technological advances have diminished distances in many ways, making mass migration a reality in many parts of the world. On the other hand, the concern with the external borders of the States and the discourses of criminalization of the figure of the immigrant grew, which culminated in the securitization of migratory movements. Faced with this reality, the thesis defended is that the relationship established between the State management of migrats flows and the ‗boat‘ migrants rights has been based on a model of conflictive governance, given the preponderance of the forces of security as the main interlocutor of immigration policies, to the detriment of the rights of migrants that are in transit. The general objective of this research will be to verify the existence of limits imposed on the exercise of state sovereignty over human mobility, in other words, in which situations the observance of human rights must surpass the sovereignty of States with regard to migrants by sea, in order to to verify the possibility of overcoming the conflictive governance model. The phenomenon of migrations by the sea and the risks inherent in them are not a problem restricted to a single continent. These issues, however, have so far not received appropriate international treatment. Thousands of lives of migrants have already been lost at crossings across the world as a result of border control strategies practiced by many States. Therefore, the urgency of the proposed research is verified in order to make it possible to reformulate migratory policies at the international level. Regarding the method of investigation adopted, the research is developed from the inductive method, being carried out a bibliographical, documentary and jurisprudential analysis. The development of this work is divided into four chapters. The first part analyzes the relationship established between sovereignty and immigration and how it is legitimized by international security. In the second chapter, it is sought to verify if the measures of securitization of vulnerable at sea adopted by developed coastal States should be considered as an expression of the regular exercise of State sovereignty or an offense to the human right of freedom of movement. In the next chapter, it is investigated whether migrants by sea have a human right to migrate or whether migrants have only immigration rights. The last chapter, analyzes if the problem faced in this work would be a problem of governance or a problem of lack of rights, proposing, in the end, possible solutions based on soft law norms. It was concluded that refugee law should be considered as the minimum threshold to be respected by the signatory States of the 1951 Convention, as well as by any State regarding the principle of non-refoulement, in the establishment of migration policies. Thus, it is essential to expressly acknowledge the need to comply with these rights in the soft standard documents that are proposed to establish a migratory governance, considering that the right to seek asylum is a relevant mitigation to the exercise of State sovereignty over migratory issues.
