Abstract

Analyse the forms of enter and promotion about the Brazilian Judiciary, focus on the changes ocasionated by the Constitutional Review nº 45/04, the STF´s interpretation above the theme, and the National Counsel Justice´s resolutions nos 11 and 06. Describe the peculiarities of the Liberal and Social State and the fundamentals of the Democrated Law State, adopted by the Federal Constitution of 1988. Classify the Supreme Popular Principle and verify your application in the structure of the Judicial Power. Investigate the legitimation´s crisis affronted by the Judiciary, in view of your standing off from common people, transforming who is under the right of a judge into vassals, however, in the reality, in face of the Democrated Law State, they are titular paramount of the power.
