Resumo: O presente trabalho propõe-se a analisar a admissibilidade das reservas aos tratados de direitos humanos, tendo em vista o conflito entre a universalidade no alcance de tais tratados, proporcionada pelo instituto das reservas, e a sua integridade, muitas vezes relativizada, ou ainda prejudicada, pelo abuso no uso delas. De fato, tal conflito é bastante peculiar, pois a fonte ética daqueles direitos é o princípio da dignidade humana, o que os faz inerentes a todo indivíduo, não podendo, portanto, ser simplesmente derrogados pelas reservas, sem que haja qualquer limitação a esta prática. Ao mesmo tempo, é incontestável que não vivemos, ainda, numa cultura universal de observância dos direitos humanos, e as reservas têm sido o meio mais adequado a possibilitar a expansão de tais direitos às mais diversas culturas. Logo, por ora, é necessário que se estabeleçam critérios de admissibilidade de reservas aos tratados de direitos humanos, de maneira a assegurar a inviolabilidade e observância de um núcleo básico inderrogável de direitos humanos, preservando-se o objeto e a finalidade do tratado, para, posteriormente, avançarmos para um processo de promoção da ratificação universal (sem reservas) destes tratados.
Abstract: This monograph has the purpose of analyzing the admissibility of reservations to human rights treaties, visualizing the conflict between the universality in the reach of such treaties, proportionated by the institute of the reservations, and its integrity, many times relativized, or still harmed, by the abuse in the use of them. In fact, such conflict is very peculiar, as the ethical source of those rights is the principle of the human being’s dignity, which makes them inherent the all individuals, not being able, therefore, simply to be repealed by the reservations, without any limitation to this practice. At the same time, it is undisputed that we do not live, still, in a universal culture of observance of the human rights, and the reservations have been the more suitable way to make possible the expansion of such rights to the most diverse cultures. Therefore, for now, it is necessary to establish criterions of admissibility of reservations to human rights treaties, in way to assure the inviolability and observance of a basic nucleus of human rights, preserving the object and the purpose of the treaty, in order to, later, advance into a process of promotion of the universal ratification (without reservations) of these treaties.
