| Abstract in Brazilian Portuguese: | Relata a discussão existente no tocante à constitucionalidade do § 4º do art. 40, da Lei nº 6.830/1980 (Lei de Execução Fiscal), que possibilitou ao Juiz reconhecer a prescrição intercorrente nos executivos fiscais de ofício. Discorre acerca do instituto da prescrição, bem como da prescrição de forma intercorrente. Analisa as teses que defendem a constitucionalidade do mencionado dispositivo legal e as contrárias a esta, com intuito de obter o posicionamento mais adequado em relação à polêmica questão. Apresenta o posicionamento defendido pelo autor, admitindo a possibilidade do reconhecimento de ofício da prescrição intercorrente nas execuções fiscais. |
| Abstract: | It relates the discussion existing regarding to the constitutionality of the § 4º of the article 40 from the Law 6.830/1980 (Law of the Execução Fiscal), that possibilities the prescription without interruption. It analyses the thesis that defend the constitutionality of the referred legal device, and its opposite ones too, with the objective of getting the best interpretation on the face of the polemic question. It presents the position defended for the author, admitting the possibility of the recognition ex officio of the prescription with interruption on the taxes executions. |
